    Unfair attacks against Scandinavian Cruisers
The Internet can be used by disgruntled people as a tool for revenge. This is a reality and we must accept it. We will respond professionally to all reasonable criticism, and reject any unfair attacks.

We have witnessed an unfair attack on Scandinavian Cruisers, by our former distributor in Tampa, Florida, Jerry A. Twomey, Boat Fix USA, Inc. / Sailtime Tampa, Inc.

On July 10, 2010, Jerry Twomey advised Scandinavian Cruisers that his boat had sustained shipping damages and had other problems. The boat did incur shipping damage and required relatively simple repair by a qualified fiberglass technician. In no instance would that damage have caused structural problems nor precluded sale of the boat ‘as new.’ In fact, many manufacturers perform similar repairs prior to shipping new boats.

Some of the reported damage was obviously the result of mishandling or abuse. The flagpole socket was likely subjected to a major ‘blow’ to incur fiberglass damage. The problem with the rudder blade was difficulty sliding into the rudder grooves due to the Coppercoat coating. We no longer apply Coppercoat on the rudder blade as owners do not leave the blade in the water at the mooring. The simple remedy is minimal sanding of the Coppercoat coating on the rudder blade.

Each Scandinavian Cruiser 20 is completely assembled prior to shipment. This includes mast, boom, rigging, sails, rudder, and keel. Shipping now includes a custom galvanized cradle with extended fiberglass bunks for improved hull support, as well as a steel framework for the shipping carton to provide maximum support and prevent any damage due to shipping and handling. Since these measures have been implemented we have not had any shipping damage.

On August 3, 2010, Jerry Twomey instructed Scandinavian Cruisers that he wanted to contract the repair work to his own boat builder named Jeremy Clark. On September 7, 2010 Jerry Twomey requested the repair work to start. On September 27, 2010, Scandinavian Cruisers transferred a 50% deposit of the repair cost to Jeremy Clark. On October 20, 2010 Jerry Twomey violated the repair work agreement by instructing Jeremy Clark to put the work on hold. This was later confirmed in a phone conversation with Jeremy Clark. Legal notice has been served to Jerry Twomey to immediately perform the agreed repair services for which partial payment was made.

In a related matter, anonymous person(s) have published a web site (www.scandinaviancruiserdot.com) and email address violating the Scandinavian Cruiser trademark, and published portions of the distribution agreement, together with unlicensed and misleading pictures of a boat that Jerry Twomey does not own. While the actual information contained on this web site clearly points to the involvement of Jerry Twomey there is no contact information or identification of the perpetrator(s) of these copyright, confidentiality and trademark violations.

Scandinavian Cruisers Ltd and Scandinavian Cruisers USA, LLC have therefore filed criminal and civil complaints in this matter with the Federal Bureau of Investigation (FBI), ICANN, Federal Trade Commission (FTC) and other government agencies investigating and prosecuting fraud, trademark and copyright violations.

The Scandinavian Cruiser 20 has received extraordinary response at international boat shows, from the international sailing press, and from enthusiastic sailors who have experienced the excitement of sailing this boat. The Scandinavian Cruiser 20 has been nominated the Sailing World “Boat of The Year 2011”, Sail Magazine “Best Boats for 2011”, “Newport for new products 2010” and has received glowing test reports by Segeln, Baadnyt, Robert Perry in Sailing Magazine, Bloomberg Markets, and Sail Magazine.

We wish to ensure all our customers, distributors and all sailors around the world that Scandinavian Cruisers stands fully behind the superior quality and design of all our boats. We know that every experienced sailor who has ever sailed the Scandinavian Cruiser 20 agrees that this is a beautiful, high performance boat of superior quality.

We suggest you ignore this unfortunate and unfounded nonsense brought about by this individual.

We look forward to our continued cooperation, and please feel free to contact us with any questions or comments that you may have.
